"BMO Community Hero of the Game" (the "Contest")

RULES AND REGULATIONS

NO PURCHASE NECESSARY. SEE ELIGIBILITY SECTION BELOW FOR FURTHER DETAILS. TO COMPLETE YOUR ENTRY YOU MUST READ AND AGREE TO THE FOLLOWING TERMS. PARTICIPATION IN THIS CONTEST CONSTITUTES FULL AND UNCONDITIONAL AGREEMENT AND ACCEPTANCE OF THESE CONTEST RULES.

ELIGIBILITY: This Contest is only open to legal residents of Ontario residing within a 75 mile radius of the City of Toronto who are 18 years of age or older. Employees (and their immediate families and those with whom they are domiciled) of Maple Leaf Sports & Entertainment Ltd. ("MLSE"), Toronto FC (the "Contest Sponsors"), Major League Soccer and its Member Teams, BMO Financial Group, the SOE Entities (as defined below) and each of their respective subsidiaries, affiliates, directors, officers, governors, agents, their advertising and promotional agencies are not eligible to enter. The "SOE Entities" shall mean SportsOnEarth, L.L.C. ("SOE") and MLB Advanced Media, L.P ("MLB") (SOE and MLB, collectively, the SOE Entities) and each of their affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, fulfillment and marketing agencies.

HOW TO ENTER: No purchase necessary. To enter the Contest, visit www.torontofc.ca between 9:00 a.m. (EST) Saturday April 28th, 2007 and 11:59 p.m. (EST) Friday, June 29th, 2007 (the "Contest Period") to nominate your choice of a person who demonstrates passion, dedication and spirit through their dedication to the community (the "BMO Community Hero"). In order for your nomination to be eligible, you must fully complete the online entry ballot and submit the ballot such that it is received prior to 11:59 p.m. June 29, 2007 (the "Contest Closing Date"). In order to be eligible for any particular game listed in the Selection Schedule below, your entry must be received prior to the listed Selection Date. If your nominee is selected, your BMO Community Hero will win one of the available prizes.

Limit one (1) entry per person. Multiple entries by the same person using one or more e-mail accounts or using any device to play multiple times or as multiple contestants will result in disqualification. All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. Potential winners may be requested to provide Contest Sponsors with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry. By entering the Contest, you agree to be bound by the decisions of the Contest Sponsors, which are final with respect to all matters relating to the Contest.

In addition, in order to be eligible to win a prize, nominees must be individuals (i.e. not a company, foundation or other organization).

All eligible nominees will be reviewed by a judging committee consisting of representatives of the Contest Sponsors on each Selection Date and will be evaluated based on the following criteria:

  • Active volunteer in their community
  • Significant contributor to an organization or the community in which they live and work
  • Demonstrates passion, dedication and spirit through their commitment to their community

All decisions as made by the Contest Sponsors are final. Only the selected nominations will be removed from the entry pool. Nominations remain active within the Contest, if not chosen, until the Contest Closing Date such that if a nomination is not selected on a Selection Date, that nomination will automatically be reconsidered on the following Selection Date.

PRIZE: There are a total of thirteen (13) Prizes available to be won each consisting each of:

  • Two (2) tickets to a 2007 Toronto FC regular season home game as indicated in the Selection Schedule in "Winner Selection" below. (specific seating to be determined by Contest Sponsors)
  • One limited edition official TFC coin; and.
  • One Toronto FC jersey.

Approximate retail value of each prize is $170 Cdn.

All incidental costs and expenses not specifically referred to herein, including (without limitation) transportation to and from BMO Field, food, beverages, items of a personal nature, delivery of prize, are not included and are the sole responsibility of the winner.

Odds of winning depend on the extent to which eligible entries meet the judging criteria.

Selected nominees and the person submitting the on line entry for those nominees will be contacted within 24 hours following the selection by telephone, e-mail or mail at the telephone number, e-mail address or mailing address, as the case may be, provided for those individuals on the official Contest ballot.

At such time, the selected nominee will be required to correctly answer, unaided, a time-limited mathematical skill-testing question to be administered by MLSE and confirm his/her eligibility. If the selected nominee and the entrant who submitted the selected nomination do not meet all of the Contest conditions, and if the selelected nominee fails to answer the skill-testing question correctly, does not sign and return the declaration and release form or contact cannot be made within such twenty-four (24) hour period, that entry will be disqualified and MLSE shall be entitled to select a new name from all remaining eligible entries. The Contest Sponsors are not responsible, whether as a result of human error or otherwise, for any failure to contact any potential winner. Once declared the winner, selected entrants will be directed as to how to claim his/her prize. GENERAL RULES: This Contest is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations. By submitting a nomination, each entrant to the Contest, , and by accepting a Prize each winning nominee, agree to hold harmless MLSE, Toronto FC, Major League Soccer and its Member Teams, the SOE Entites, and each of their respective subsidiaries, affiliates, directors, officers, governors, agents, their advertising and promotional agencies (collectively, the "Released Parties") against any and all liability, damages or causes of action (however named or described) with respect to or arising out of: (i) entrant's participation in the Contest, (ii) the receipt or use of the prizes awarded therein; and (iii) the administration of the Contest and distribution of the prizes awarded therein. Before being awarded a Prize, potential winners and their guests must sign MLSE's standard form of Declaration, Release and Waiver form, releasing the Released Parties from any and all liability arising from, among other things: (i) participation in the Contest; and (ii) acceptance of the prizes awarded therein; and (iii) the administration of the Contest and distribution of the prizes awarded therein.

By submitting a nomination , each entrant, and by accepting a Prize, each winning nominee grants to the Contest Sponsors, the SOE Entities and Major League Soccer the right to the use of his or her name, likeness or photograph without compensation in any publicity or for promotional purposes carried out by the above parties. Without limiting the foregoing, each entrant and each selected nominee acknowledges and agrees that he or she may be identified and announced as the nominating party or the BMO "Hero", as the case may be on the public address system at BMO Field at the game the winning nominee attends as a prizewinner. The name of the Prize winners may be published on the BMO Web site or names and photos could potentially be sent to local media papers. All personal information contained on the ballot respecting the person submitting same and his/her BMO Community "Hero" nominee shall be used by the Contest Sponsor and its agents solely for the purpose of administering the Contest, unless such person expressly consents to the use of such information for any other purpose, and shall be subject to the terms of BMO's Privacy Code, which may be viewed at www.bmo.com.

Prizes must be accepted as awarded and are non-transferable and cannot be exchanged for cash or otherwise. No telephone contact or correspondence will be entered into except with potential prize winners.

MLSE reserves the right to substitute prizes of equal or greater value and/or to terminate, modify or withdraw this Contest, in whole or in part (including altering the manner in which the prizes are distributed), at any time, without prior notice for any reason including, but not limited to viruses, bugs, tampering or other causes beyond MLSE's control affect the administration, security, fairness or proper play or conduct of the Contest. In the event a substitute prize is awarded, such prize must be accepted as awarded and cannot be exchanged for cash or otherwise. Further, MLSE reserves the right to disqualify any person and void any entries of that person who it believes has tampered with the entry process or any other component of the Contest, whose conduct or action affects the administration, security or fairness, integrity or proper conduct of the Contest, or who fails to meet or abide by the Contest Rules and conditions.

MLSE does not assume any responsibility for tampering, theft, defects, viruses, human errors including negligence, deletions, technical or telephone, computer line, network, server, access providers, computer equipment or software problems, undeliverable messages, computer errors, lost, misdirected, late or incomplete entries or inaccurate capture of information or any online difficulties that may result in damage or malfunction the computer or the failure of MLSE to process any entry and otherwise award any prize. Nor is responsibility assumed for printing errors appearing in these rules or related Contest materials. In addition, the Contest Sponsors will not assume any responsibility of any nature whatsoever in all cases where their inability to hold the Contest or to remit the prizes to the winners results from a cause beyond their control, including Acts of God, weather conditions, strike, lock-out or other labour dispute. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should an attempt be made, MLSE reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. The Contest is subject to all applicable federal, provincial and municipal laws and regulations and shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
