2007 Houston Dynamo Anthem Competition - OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. CONTEST VOID WHERE PROHIBITED.
ALL QUESTIONS SHOULD BE DIRECTED TO THE HOUSTON DYNAMO.
INTRODUCTION. 2007 HOUSTON DYNAMO "LET YOUR VOICE BE HEARD" ANTHEM COMPETITION (the "Contest"). Details of the prizes and how to enter the Contest are contained in these Official Rules. By entering the Contest, all entrants and contestants agree to comply with and be bound by the terms and conditions of these Official Rules.
ONE WAY TO ENTER. Contestants must enter the Contest via regular mail. Contestants must completely fill out the entry form found online and mail the form, along with a CD (containing their own renditions of the "National Anthem"), in a single, padded envelope, with sufficient first class postage affixed, to: The Houston Dynamo, "Let Your Voice Be Heard," 1415 Louisiana Street, Suite 3400, Houston, TX 77002.
Limit: one entry per person. No individual may enter more than once.
AEG Houston Soccer, Inc., dba The Houston Dynamo and the Bayou City Art Festival are collectively referred to hereafter as the ("Sponsors"), The Sponsors are not responsible for lost, late, incomplete, garbled, illegible, misdirection due to postage Contest entries, or for any error, human, technical or otherwise, which may occur in the processing of Contest entries. Proof of sending will not be deemed to be proof of receipt. All entries (and all copyright and other intellectual property rights therein) become the exclusive property of Sponsors, and will not be acknowledged or returned.
TIMING. The Contest entry period begins on Tuesday, February 27, 2007 at 11:00 a.m. CT and ends on Tuesday, March 13, 2007 (the "Entry Period"). Entries must be postmarked on or before Tuesday, March 13, 2007 and received by Sponsor no later than Sunday, March 18, 2007. Entries received after March 18, 2007 will not be eligible.
ELIGIBILITY. The Contest is open to all residents of the State of Texas. Void where prohibited by law. Employees of Sponsors, or their respective affiliates, subsidiaries, or advertising or promotion agencies, are not eligible, nor are members of these employees' families (defined as parents, children, siblings, spouse, and life partners).
AGREEMENT TO OFFICIAL RULES. Participation in the Contest constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules.
SELECTION OF POTENTIAL WINNER. Selection of a winner will occur in two (2) phases.
In phase one, a panel of judges appointed from the Sponsors will judge the CD submission of each participant and determine (in such panel's sole discretion) 15 potential finalists.
Potential finalists will be notified by Sponsors via telephone on or around Monday, March 19, 2007. Potential finalists will have twenty-four (24) hours from notification to respond to and speak with an authorized representative of Sponsors. If a potential finalist cannot be contacted or does not respond to and speak with an authorized representative of Sponsors within the twenty-four (24) hour notification period, an alternate finalist will be selected by the panel of judges (in the panel's sole discretion) from the remaining qualified. Potential finalists who respond and speak with an authorized representative of Sponsors within the twenty-four (24) hour notification period will be emailed an Affidavit of Eligibility/Release of Liability/Publicity Consent to be completed the contestant. If this form is not brought by the contestant to the final event on Saturday March 24, 2007, they will not be allowed to participate in the final contest.
In phase two, qualifying potential finalists will be required to travel at their own expense to the Bayou City Art Festival located in Houston, Texas to perform a one (1) song routine live on stage at the Broadway Cafe at the "LET YOUR VOICE BE HEARD" finals. At the Event, each finalist's live routine must consist of a one song.
Song Choice
Musical selections performed by the finalists must be chosen from the approved song list found online, unless prior arrangements with the Sponsors have been made.
Contestants will be judged based on the following criteria and awarded up to a total of one hundred (50) points):
- Vocal Ability (rhythm/pitch/phrasing) 1-30 points
- Stage Presence (movement/confidence/command) 1-10 points
- Appearance (costume/attire) 1-10 points
The Grand Prize winner will be selected from among the qualified finalists present and performing at the Event by a panel of qualified entertainment industry judges appointed by the Sponsors (in their sole discretion). The panel of judges will determine (in the panel's sole discretion) the winner based on the criteria set forth above. In the event of a tie, the respective contestants will then perform their rendition of the "National Anthem". The order in which the contestants perform will be determined by a coin toss to be made by each contestant. The panel of judges will then determine (in the panel's sole discretion) the winner based on the same criteria as set forth above.
Finalists will be responsible for any and all expenses related to the Event, including, but not limited to: (i) travel to and the Bayou City Art Festival, (ii) accommodations, (iii) meals, and (iv) and all other expenses, including taxes, tips and gratuities.
All minors must be accompanied to the Event by a parent or legal guardian, or by a person of the age of legal majority authorized by the applicable minor's parent or legal guardian. All minors must be supervised at all times during the Event by a person of the age of legal majority. By attending the Event, finalist's traveling companions or adult chaperones agree to comply with these Official Rules.
Sponsors reserve the right, in their sole and absolute discretion, to disqualify any entry or finalist, which does not comply with the requirements and conditions set forth in these Official Rules. All costumes, props, routines and song selections must be appropriate for an "all-ages" audience, and all routines and song selections of finalists are subject to the prior approval of Sponsors on this basis. Decisions by Sponsors in all matters related to administration of the Contest and the selection of a winner are final. Potential winner must comply with all terms and conditions set forth in these Official Rules, and winning and award of the Prize is contingent upon fulfilling all requirements. The winner will be chosen and notified at the Event.
PRIZE. One (1) winning contestant will be invited to sing the "National Anthem" at one (1) Houston Dynamo 2007 Season home game (game to be determined by mutual agreement of the parties) and will receive two (2) tickets for winner and guest to the game at which winner performs (seat location to be designated by Houston Dynamo). Approximate retail value of the tickets: $32.00
GENERAL CONDITIONS. The Contest is governed by the laws of the United States and the State of Texas, excluding conflicts at laws principles. Contest is void where prohibited. Contest may only be entered in or from the State of Texas and entries originating from any other jurisdiction are not eligible for entry.
Contestants hereby consent to the exclusive jurisdiction and venue of Texas courts (state and federal) in Harris County for any causes or controversies arising out of the Contest. Each contestant waives any and all objectives to jurisdiction and venue in these courts.
Except where prohibited by law, all contestants (including the winner) grant to Sponsors and their advertising agencies the right to use, broadcast, transmit, record and publish their photos, proper names, images, likenesses, voices, opinions, biographical information and state in any media to promote Sponsors, the Event and the Contest without additional compensation (including, without limitation, the right to record and broadcast in any media all submissions of contestants and the performances of the finalists at the Event).
Contestants release, and indemnity and hold harmless Sponsors, Anschutz Entertainment Group, Inc. and their respective subsidiaries, affiliates, directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind, including death, and/or any claim of infringement arising from or in connection with the Contest and/or a contestant's submission or receipt, use and/or misuse of any prize.
Sponsors reserve the right to cancel or modify the Contest if fraud, misrepresentation or any other factor impairs the integrity of the Contest as determined by Sponsors in their sole discretion.
If, in the opinion of the Sponsors, there is any suspected or actual evidence of tampering with any portion of the Contest, or if technical difficulties compromise the integrity of the Contest, the Sponsors reserve the right in their sole discretion to void any entries at issue (including disqualifying any individual or contestant who tampers or otherwise interferes with the entry process or submits fraudulent or false entry), and to cancel, terminate, modify or suspend the Contest, in whole or in part, at any time without notice. In the event of such cancellation, Sponsors reserve the right to award the prize to the qualified finalist present at the Event receiving the next highest number of votes (subject to the tie-breaking criteria set forth above).
Sponsors in no way promote illegal acts, and any and all entries, which include or promote illegal acts will be disqualified, as will any contestant who promotes or commits illegal acts.
Any misconduct or display of offensive behavior by any member contestant at the Event may be grounds for disqualification of the band by Sponsors in their sole and absolute discretion.
Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of unauthorized access to, or alternation of, entries. Sponsors are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry received by Sponsors on account of technical, any combination thereof, or otherwise, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in the Contest.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Contest results and copy of these Official Rules may be obtained by sending a self-addressed, stamped envelope to: 2007 HOUSTON DYNAMO "LET YOUR VOICE BE HEARD" ANTHEM COMPETITION 1415 Louisiana Street, Suite 3400, Houston, TX 77002. Request for results must be postmarked after March 24, 2007 and received before April 30, 2007.
